Rules
1. General Provisions
1.1. The Rules (Agreement) explains the procedure by which digital money is exchanged using the online service.
1.2. In this case, online service is an Internet portal that hosts an online resource that provides digital money exchange services - COIN EXPRESS.com
1.3. A private individual or a representative of a legal organization who wishes to use the COIN EXPRESS online services portal is hereinafter referred to as the User.
1.4. In the future, when referring to the User and COIN EXPRESS online service, the name of the Party will be used.
1.5. The parties mutually accept the legal force of this electronic agreement, which determines the procedure for business interaction between the User (a private individual or a representative of a legal organization) and the party providing services (COIN EXPRESS).
1.6. This Agreement is public, the User accepts its terms at the moment when he submits an application on the COIN EXPRESS online service web portal for the services provided by the COIN EXPRESS online service.
2. Subject of the Agreement
2.1. Online Service COIN EXPRESS provides services, the essence of which is prescribed in paragraph 4, to the User only if his actions comply with the conditions prescribed in paragraph 9. Clause 5 of the Agreement sets out the conditions for the internal operation of the COIN EXPRESS online service, which determine the procedure for the provision of services.
2.12. The agreement sets out the conditions under which the User accepts COIN EXPRESS online services and pays for them in full.
3. Rights and obligations of the Parties
3.1. COIN EXPRESS online service is obliged
3.1.1. To carry out the exchange of electronic money of the following online wallets: Qiwi, Payeer, Perfect Money, Yandex.Money and similar payment systems, including banking, following the procedure established by the Agreement.
3.1.2. Provide full support (informational and technical) to Users who use the COIN EXPRESS portal to conduct transactions.
3.1.3. Save all data regarding financial transactions conducted by the User (personal information about the User, time of transactions, amount, etc.) and provide this information only to the User authorized for this operation. All information about transactions is considered secret and is not disclosed to other persons.
3.1.4. Personal information is not transferred to third parties except in the following cases:
- if there is an effective court order located at the location of the COIN EXPRESS online service;
- upon receipt of an official request from the financial regulatory authorities or law enforcement representatives located at the place of registration of the COIN EXPRESS online service;
- when contacting the management of one of the above electronic payment systems.
3.1.5. Take into account the User"s right to use the discount.
3.1.6. Upon receipt of a complaint from the User or a third party in accordance with clauses 3.2.5, 5.4, 5.5 or 5.6 of this Agreement, conduct a reverse transaction within 24 hours.
3.2 The user is obliged
3.2.1. Provide correct information and accurate details to ensure timely crediting of money transactions.
3.2.2. Provide correct information about a valid email address.
3.2.3. Open access to your email to receive messages from the system. Provide access to the Internet system from a computer or other electronic device. Use current versions of anti-virus software to secure the connection to the COIN EXPRESS online service.
3.2.4. Fulfill the conditions established by these Agreements.
3.2.5. Notify the administration of the portal providing services that the funds have not been partially or completely received by the addressee on the specified account of the User or a third party. Notify about the situations specified in paragraphs 5.4, 5.5, 5.6 of this Agreement. Information must be provided within 1 month, starting from the moment the funds were not credited to the account. If the condition is not met, then the entire amount will become the property of the COIN EXPRESS online service without the right to return.
3.2.6. Adhere to statutory procedures regarding online money transactions.
3.2.7. Do not wind up traffic using different systems.
3.2.8. The User guarantees that at the time of interaction with the COIN EXPRESS portal he has reached the age of majority in accordance with the laws of the country where the User is located.
3.3. The COIN EXPRESS service representative has the right to:
3.3.1. To upgrade the resource, fix technical problems and not provide services at this time.
3.3.2. Suspend the execution of the transaction until the circumstances are clarified, if a complaint or information about fraud is filed from law enforcement agencies, the User, a representative of the above partners (payment systems).
3.3.3. Determine the system of discounts for the services provided at your own discretion.
3.3.4. Determine at your discretion the amount of the commission for the provision of services.
3.3.5. Refuse to provide services to the intended User without explaining the reason.
3.3.6. Receive from the User information that proves the fact of the transaction through a mobile phone, e-mail, a screenshot showing a fragment of an electronic wallet, in cases where the operation was completed by an error.
3.3.7. Stop cooperation with the User who raises a topic that is not related to the essence of the issue, is rude, does not provide the information requested by technical support.
3.3.8 Based on clauses 5.4, 5.5 and 5.6 of the agreement and the established Regulations, block the ongoing transaction.
3.3.9. Suspend the transaction and not issue money to the User until the identity is established.
3.3.10. In a situation where the User has violated clause 3.2.7, he, as well as the source / generator of transitions, may be blocked by the Administration of the COIN EXPRESS online service.
3.3.11. The COIN EXPRESS online service administration has the right to stop the execution of the operation, in case of unreasonable enrichment of the User with COIN EXPRESS online service digital money, until the situation is clarified. It can also reimburse unreasonably received financial resources, property rights to them using the online service of COIN EXPRESS or the partner"s payment system.
4. Services provided
4.1. COIN EXPRESS online service provides transaction services for the following payment systems: Bitcoin, Qiwi, Payeer, Perfect Money, Yandex.Money and the like. The full list of partners can be found on the portal.
4.2. The COIN EXPRESS online service does not check where the User has the funds involved in the operation and their legitimacy.
5. Regulations for the conversion of electronic money
5.1. At the beginning, the User creates an application for conversion, and deposits money for its implementation. The conversion will not take place if the funds are not credited to the account within the set time (20 minutes for currency and 90 minutes for cryptocurrency). If funds are not credited, the transaction will be automatically canceled by the COIN EXPRESS Online Service. If the money is credited in excess of the standard, then the exchange will take place at the rate at the time the money was credited.
5.2. The operation is considered successful after the funds are in the account indicated by the User in the application.
5.3. If the funds have already been sent for processing, the transaction cannot be canceled and they will not be returned.
5.4. If the amount credited from the User does not match the amount specified in the application, then the COIN EXPRESS online service may stop the operation and recalculate the transaction according to the funds actually received. In case of blocking the operation, the User, focusing on clause 3.2.5, may apply for a refund to his account at the rate that was at the time of enrollment.
5.5. In the event that the User provides incorrect or blocked details, and the funds are not received by the addressee, they will be returned after the request (if technically possible) in accordance with clause 3.2.5.
5.6. In such cases as correction of payment notes, depositing the amount from another account, the received amount is blocked by the COIN EXPRESS online service until the User applies in accordance with clause 3.2.5. After which the funds will be returned (if possible).
5.7. When the User completes an operation to credit the Bitcoin cryptocurrency, the period when the digital money will be credited to the account depends on the Bitcoin system itself, its workload, and can be up to about 15 days. In this situation, COIN EXPRESS Online Service is not responsible for the speed of enrollment.
5.8. In any case, when a refund is made, a commission of 5% is withheld, except for paragraph 3.a specified in the AML.
6. Responsibility of the Parties
6.1. COIN EXPRESS online service is not responsible for errors made by the User when filling in the details and other items of the conversion request, as well as for attempts to misuse the services provided. If the amount was nevertheless credited to incorrectly specified details, a refund is not expected.
6.2. The COIN EXPRESS online service does not compensate for the damage that occurred due to the failure of the User"s equipment.
6.3. COIN EXPRESS online service is not responsible for delays in the transfer of funds or errors in the course of transactions, if the cause was the actions of a third party (payment systems or banks).
6.4. COIN EXPRESS Online Service is not responsible for the User"s losses as a result of his incorrect interpretation of the established tariffs, incorrect calculation of profit as a result of a transaction or other subjective reasons.
6.5 Online Service COIN EXPRESS shall not be liable in case of any costs associated with the delay or cancellation of the transfer of funds.
6.6. The user confirms by his agreement that the funds that he uses for transactions are received without breaking the law, or he owns them legally.
6.7. The user compensates the losses of the third party, which are connected with his actions on the portal, indirectly or directly.
7. Changing information
7.1. COIN EXPRESS Online Service Administration may amend this Agreement. Adjustments come into force from the moment they are published on the portal.
8. Force majeure
8.1. In the event of force majeure circumstances, the Parties are not responsible for non-compliance with obligations under this Agreement or delay in their implementation in time. Circumstances include: natural disasters, massive civil unrest, hostilities, attacks by hackers, terrorist attacks, fires. Also under this category fall failures of access to the Internet, other types of communication, power outages.
9. Mandatory conditions for conducting exchange transactions
9.1. It is strictly forbidden to use the COIN EXPRESS Online Services to conduct illegal financial transactions. The user assumes responsibility. If the User attempts to conduct transactions using illegally obtained funds, he will be punished by the laws of the country in whose territory the conversion was attempted.
9.2. The COIN EXPRESS online service has the right to open access to information about duly proven illegal transactions to third parties (a payment system representative affected by fraud, competent authorities).
9.3. The exchange is considered to be carried out provided that the User withdraws electronic money from his own digital wallet. The COIN EXPRESS online service does not verify the legitimacy of the credited funds, therefore the User is responsible for the compliance of the operation with legislative acts.
9.4. The COIN EXPRESS online service is not responsible for transactions carried out by a third party authorized by the User.
9.5. The user guarantees the passage of the verification procedure (AML / KYC) at the first request of the portal administration. The terms of the AML/KYC policy of the COIN EXPRESS portal are indicated on the corresponding page of the service.
9.6. The item “I agree with the exchange rules” in the application means the User accepts all the clauses of this Agreement.
